BTC Markets: Survey and Research Program T&Cs

1. WHAT IS THE RESEARCH PROGRAM?

1.1 The BTC Markets Survey and Research Program (Research Program) is conducted by BTC Markets Pty Ltd ACN 164 093 887 (BTC Markets or we) in accordance with these terms and conditions.

1.2 The Research Program comprises online customer surveys that eligible participants may be invited to complete from time to time (each, a Survey) and customer interviews (Interviews). In return for participating, eligible participants may receive a credit to the account they hold with BTC Markets (Account).

1.3 By starting a Survey, submitting a Registration Form, or booking or attending an Interview, you will be deemed to have accepted these terms and conditions. You must not participate in the Research Program if you do not agree with these terms and conditions.

1.4 Participation in the Research Program is voluntary and does not affect your Account.

2. KEY DATES AND DEADLINES

2.1 The dates and deadlines that apply to you, including the date by which a Survey must be completed, the date by which an Interview must be completed and the date by which Rewards will be paid, are those specified in the email or other communication provided by BTC Markets to you in relation to the Research Program (Communication).

2.2 BTC Markets may send Communications to different participants at different times, and the dates and deadlines specified in each Communication may differ.

2.3 A Survey or Interview completed after the deadline specified in the relevant Communication will not be eligible for a Reward, unless BTC Markets agrees otherwise.

3. ELIGIBILITY CONDITIONS

3.1 In order to be eligible to participate in the Research Program and receive a Reward, you must:

(a) be at least 18 years old and ordinarily reside in Australia;

(b) hold an open, verified Account in good standing, both at the time you participate and at the time the Reward is paid;

(c) act in good faith and not breach any applicable laws;

(d) have received a Communication from BTC Markets inviting you to participate; and

(e) comply with these terms and conditions and BTC Markets’ Terms of Use (available at www.btcmarkets.net/terms-of-service).

3.2 Each Survey and each Interview may only be completed once per eligible participant and are not transferable. Your Communication, Survey link, Booking Form and any Reward are personal to you and must not be transferred to, shared with or completed by any other person.

4. SURVEY REWARD DETAILS: ACCOUNT CREDIT

4.1 BTC Markets may, from time to time, invite you to complete a Survey by sending you a Communication containing a personalised link to that Survey. You may be invited to complete Surveys on more than one occasion. In order to be eligible for a Survey Reward, you must complete the relevant Survey using the personalised link in the relevant Communication, by the deadline specified in it.

4.2 You may notify BTC Markets at any time that you no longer wish to be invited to participate in future Surveys.

4.3 Your personalised link is used to match your Survey response to your Account. Survey responses submitted other than through your personalised link cannot be matched to your Account and will not be eligible for a Survey Reward.

4.4 Subject to clause 6, you will receive a credit to your Account (for an amount specified in the relevant Communication) upon completion of the relevant Survey (Survey Reward).

4.5 Only one Survey Reward is available per eligible participant for each Survey.

5. INTERVIEW REWARD DETAILS: ACCOUNT CREDIT

5.1 You may opt in to be contacted by BTC Markets, from time to time, to participate in Interviews in connection with the Research Program by completing a registration form (Registration Form). The Registration Form may be made available at the end of a Survey or provided to you separately in a Communication. You do not need to complete a Survey in order to submit a Registration Form.

5.2 Submitting a Registration Form does not guarantee that you will be contacted to participate in an Interview. BTC Markets may select Interview participants in its absolute discretion and is not required to provide reasons for its selection or non-selection of any person. BTC Markets will only contact you if you are selected. You may be selected to participate in Interviews on more than one occasion.

5.3 You may notify BTC Markets at any time that you no longer wish to participate in future Interviews.

5.4 Each time you are selected, BTC Markets will send you a Communication containing a booking form (Booking Form). Each Interview must be booked, conducted and completed on Microsoft Teams by the deadline specified in the relevant Communication.

5.5 The Booking Form will give you the option to consent, or not consent, to BTC Markets recording and transcribing your Interview. If you consent, BTC Markets may record and transcribe your Interview. If you do not consent, or you withdraw your consent before or during the Interview, BTC Markets will not record or transcribe your Interview and will instead take written notes. Your choice will not affect your eligibility to participate in an Interview or to receive an Interview Reward. Any recordings, transcripts and notes will be used by BTC Markets solely for the purposes of the Research Program.

5.6 Subject to clause 6, you will receive a credit (for an amount specified in the relevant Communication) upon completion of the Interview (Interview Reward).

5.7 For the avoidance of doubt, an Interview is completed if you attend and participate in the Interview for the entire allocated time, or if the Interview ends early at the request of BTC Markets. No Interview Reward is payable for submitting a Registration Form, being selected for or booking an Interview, or if you do not attend, cancel or leave the Interview early, or BTC Markets ends the Interview due to inappropriate conduct.

6. REWARD CONDITIONS

6.1 The Survey Reward and the Interview Reward (each, a Reward) will only be provided if you:

(a) complete the relevant Survey or Interview (as applicable) by the deadline specified in the relevant Communication;

(b) provide full and complete responses to all questions; and

(c) satisfy the eligibility conditions in clause 3.

6.2 Subject to clause 6.1, the provision of a Reward is otherwise at the discretion of BTC Markets, acting reasonably. Without limiting that discretion, BTC Markets may withhold or reverse a Reward if it reasonably believes that:

(a) a response is duplicated, automated, not genuine or fraudulent;

(b) a response was made using another person’s link or Communication;

(c) you have breached these terms and conditions or the BTC Markets Terms of Use; or

(d) your Account is closed, suspended or restricted.

6.3 Rewards will be credited in AUD to your Account within the period specified in your Communication or, if no period is specified, within 15 business days after the deadline for the relevant Survey or the date of the relevant completed Interview (as applicable).

6.4 Once credited, a Reward forms part of your Account balance and is subject to the BTC Markets Terms of Use. Rewards are not transferable.

6.5 Rewards may have tax consequences. You are responsible for any tax payable in connection with a Reward.

7. FEEDBACK AND INTELLECTUAL PROPERTY

7.1 All Survey responses, information, comments, ideas, suggestions and other material you provide in connection with the Research Program, including anything you say or show during an Interview and any recordings, transcripts and notes of it (Feedback), are owned by BTC Markets.

7.2 You assign to BTC Markets all right, title and interest in the Feedback, including all intellectual property rights, throughout the world, with effect from the time the Feedback is created. If any right cannot be assigned, you grant BTC Markets a perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable licence to use that Feedback for any purpose.

7.3 To the extent permitted by law, you consent to any act or omission by BTC Markets in relation to the Feedback that would otherwise infringe your moral rights, including using the Feedback without attribution or altering it.

7.4 BTC Markets may use the Feedback for any purpose without any obligation to you. A Reward is provided as a complimentary gesture for your time and is the only amount payable to you in connection with the Research Program.

7.5 You must ensure that your Feedback is your own and does not include any other person’s confidential or personal information.

7.6 BTC Markets will not publish any material that identifies you as the source of any Feedback.

7.7 This clause 7 survives the end of the Research Program and your withdrawal from it.

8. CONFIDENTIALITY

8.1 During the Research Program, BTC Markets may show you features, products or ideas that are not yet public. You must not share, screenshot or post about them without the express written consent of BTC Markets.

9. GENERAL INFORMATION

9.1 These terms and conditions apply in addition to our Terms of Use and Privacy Policy (available at www.btcmarkets.net/privacy-policy).

9.2 We may amend, suspend or end the Research Program or these terms at our absolute discretion without providing notice to you. Any updates to these terms will be published on our website (www.btcmarkets.net) and will apply on and from the date of publication. You will be deemed to have agreed to the amended terms if you participate in the Research Program after the date the amended terms are posted on our website.

9.3 Nothing in these terms and conditions excludes any right under the Australian Consumer Law that cannot be excluded.

9.4 You cannot transfer or assign your rights under these terms and conditions.

9.5 If any term is declared unlawful, void or unenforceable, that term will be deemed severable and will not affect the validity and enforceability of the remaining provisions of these terms and conditions.

9.6 These terms and conditions are governed by the laws in force in Victoria and the parties submit to the non-exclusive jurisdiction of the courts in that jurisdiction.
