Terms & conditions

1. WHAT’S THE PROMOTION?

1.1 The BTC/AUD Fee Free Trading Day is conducted by BTC Markets Pty Ltd ACN 164 093 887 (BTC Markets, we or our) in accordance with these terms and conditions.

1.2 To celebrate our 10th birthday, BTC Markets is waiving its trading fee (trading fee) on BTC/AUD trades undertaken by customers on its platform during the promotion period (promotion).

1.3 The promotion will run between 12.01am – 11.59pm, 2 June 2023 (promotion period). We may amend the promotion period at our absolute discretion.

1.4 By entering in the promotion, you will be deemed to have accepted these terms and conditions. You must not participate in the promotion if you do not agree with these terms and conditions.

2. ELIGIBILITY CONDITIONS

2.1 In order to be eligible to participate in the promotion, you must:

(a) be at least 18 years old and ordinarily reside in Australia;

(b) be our customer and hold an active account with us (BTC Markets Account);

(c) act in good faith and not breach any applicable laws;

(d) comply with the terms and conditions of any social media platforms in which the promotion offer is published or distributed; and

(e) comply with any other conditions we may prescribe in relation to the promotion offer, which will be available at www.btcmarkets.net; and

(f) comply with the terms of service of the BTC Markets Account, available at www.btcmarkets.net/terms-of-service.

2.2 The promotion will only apply to:

(a) any trades executed with respect to the BTC/AUD pair; or

(b) any limit order placed with respect to the BTC/AUD pair,

during the promotion period. To avoid doubt, the promotion only applies to trades undertaken on the BTC/AUD pair offered on our platform. Our standard rates and charges will continue to apply for trades undertaken on all other trading pairs offered on our platform.

2.3 Where a limit order is placed in accordance with clause 2.2(b), the promotion will continue to apply even if one or more trades that are subject to that limit order are executed outside the promotion period.

2.4 The trading fee is limited to the fee that is charged by BTC Markets with respect to a BTC/AUD trade executed pursuant to the promotion. Each trade will continue to be subject to gas fees and other fees and expenses charged by third-parties.

2.5 The fee with regard to this promotion is $0. You will be charged $0 fees at the time you execute your order.

2.6 There are no limits to the number of trades that are eligible to participate in the promotion.

2.7 Notwithstanding any other clause of these terms and conditions, if we believe you have:

(a) engaged in any fraud or material abuse of the promotion;

(b) entered or proposed to enter into a trade that is in breach of our standard terms and conditions;

(c) reserves the right to disqualify trades that are deemed to be wash trades or illegally bulk registered accounts, as well as trades that display attributes of self-dealing or market manipulation,

then we may, in our absolute discretion, notify you that you are not entitled to participate in the promotion. To avoid doubt, we may provide you with this notice after you have entered into or otherwise completed the relevant trade. 

2.8 We will not be liable for any failure or delay in waiving or otherwise providing you with trading fees that you are entitled to receive under the promotion. We will not be liable for any loss or expenses you incur in connection with the promotion.

2.9 The promotion does not constitute an inducement or endorsement by us to enter into any BTC/AUD trades during the promotion period. You should consider your own personal circumstances before deciding whether to enter into any relevant trade, and if in doubt, seek professional advice.

3. GENERAL INFORMATION

3.1 These terms and conditions apply in addition to our terms of service, which are available at www.btcmarkets.net/terms-of-service.

3.2 These terms and conditions are governed by the laws in force in Victoria and the parties submit to the non-exclusive jurisdiction of the courts in that jurisdiction.

3.3 We may amend these terms and conditions or cease offering the promotion at any time at our absolute discretion and without providing notice to you. Where we amend these terms and conditions, your entry (or continued entry) in any promotion will amount to acceptance of these terms and conditions as amended.

3.4 You cannot transfer or assign your rights under these terms and conditions.

3.5 If any term is declared unlawful, void or unenforceable, that term will be deemed severable and will not affect the validity and enforceability of the remaining provisions of these terms and conditions.
